The Supreme Court disposed of a number of petitions challenging the guidelines issued by the University Grants Commission (UGC) for conducting final semester exams.
The bench refused the prayer to quash the UGC guidelines concerning the conduct of the exams. Given the authority, the directions by the State Disaster Management Authority in regards to the cancellation of the exams in the respective states will prevail over the directions of the UGC. The State Disaster Management Authority cannot pass the students on the basis of their previous year’s performance as this stands to be out of the ambit of the Disaster Management Act. Students cannot be promoted without passing the exams but the states can approach the UGC for postponing the exams as the situation is not suitable for the same.
