A writ petition was filed by the parents of the deceased, Kripesh and Sarath Lal, two Youth Congress leaders aged 22 and 24 years respectively, who were brutally murdered on the 17th of February, 2019 at about 7:45 pm by the accused persons, who were CPM workers, due to political vengeance. After having considered every aspect of the case, the single bench of Justice B Sudheendra Kumar ordered a CBI probe into the matter. On a careful perusal of the case, the Division Bench of the Kerala High Court was of the opinion that a lot of prima facie evidence had been missed out due to the slackness and incomplete investigation of the Kerala Crime Branch that may possibly result in the miscarriage of justice.
To instil some confidence in the case, the Kerala High Court decided to uphold the Single Bench order by directing a CBI probe on the basis of the re-registration of the case and also file a supplementary report in accordance with the provisions of Section 173 (8), Cr.P.C. that shall be submitted post “further investigation”. On receipt of the same, the trial court shall consider both the reports filed by CBI and SIT of the Kasaragod Crime Branch and then proceed with the case in accordance with the law.
