Plea To Transfer PM CARES Fund To NDRF Dismissed By Supreme Court

On 18th August 2020, the Supreme Court dismissed the plea filed to transfer the PM CARES Fund to the National Disaster Relief Fund (NDRF) on the grounds that there was no need for a fresh national disaster relief plan for COVID-19 and the minimum standards of relief as issued under the Disaster Management Act, 2005 prior to COVID-19 were enough.

The plea was filed by Center for Public Interest Litigation, led by Advocate Prashant Bhushan on 27th July 2020 before the bench of comprising Ashok Bhushan, R. Subhash Reddy & MR Shah who reserved the judgment on the issue of transfer of funds from PM CARES Fund to NDRF under the National Disaster Management Act, 2005.

The Plea sought to transfer these funds since the PM CARES Fund was set up to combat COVID-19 to NDRF which will help in setting up a National Plan under Section 11 read with Section 10 and also to lay down minimum standards of relief under Section 12 of the Disaster Management Act, 2005.

The Supreme Court bench also clarified that they will transfer the funds to NDRF as and when they deem fit and necessary and the individuals are at liberty to donate.
